Despite the fact that Kentucky is a no-fault state, drivers are still required to have a state mandated minimum of car insurance coverage to legally operate a vehicle.

The primary difference that sets Kentucky apart from the rest of the states is the fact that they operate under a Choice No-Fault system. This is a combination between having a No-Fault system, in which the insurance company will pay the drivers claims even if they are at fault, and a Tort system, which means that at least one driver must be found at fault for the accident – the driver at fault in the Tort system is required to pay for the damages to the other part. Most states do not allow drivers to have a choice between the two systems.

Regardless of the system chosen, Kentucky drivers retain the right to sue for any type of injury related to the accident. Similar to many other states, Kentucky does offer its drivers special discounts for good driving behavior, grades, and theft protection. Additionally, all insurance agencies within the state are allowed to set their own rates, which is beneficial to KY residents because it keeps the insurance market competitive and the overall rate affordable.
