South Dakota residents can provide proof of financial responsibility to legally drive in the state in four different ways. Starting with the option to self-insure residents must have a minimum of 26 vehicles registered in their names to avail themselves of this option. Other options include a surety bond with an in state broker who is authorized to carry out these transactions, a $50k certificate of deposit with the state treasurer or the more traditional liability insurance through regular insurance companies.
Drivers who opt to purchase liability insurance for private passenger vehicles must purchase a minimum of $25k for body injury or death to one individual, $50k for body injury or the death for two persons or more per accident and $25k for damage to one's personal property. Most insurance agents will recommend that you increase your coverage in order to be fully covered in the event of an accident. You need to also consider purchasing some type of coverage for yourself so you won’t have to pay out of pocket for your damages, medical expenses or loss of wages if you are found at fault in an accident.
If you are ever pulled over by a law enforcement officer or have an accident you will be asked to provide proof of insurance. In South Dakota this proof can be provided in the form of a valid insurance identification card from your insurer, a certificate of self-insurance or a certificate of deposit as issued from the state treasurer.
The state considers driving without insurance as a serious offence and drivers who do this, face fines of $100 or more and time in county jail, suspension of their licenses, orders to provide proof of insurance to the state for up to three years and higher premiums due to a SR-22 status.
